Most acupuncture schools do not require their enrollees to have undergraduate degree; however, most acupuncture schools require their students to have attended a course in college at least for two years. Degree holders are however most likely to be admitted in an acupuncture school, especially in a highly accredited one. The Accreditation Commission for Acupuncture and Oriental Medicine or ACAOM is the one that accredits an acupuncture school. If you seek for excellence in acupuncture studies, it would be best to enroll in an acupuncture school accredited by ACAOM. Normally, it would take you three years to finish a degree in acupuncture. For working students, night programs and part-time acupuncture programs are also available. If you enroll in these programs, it may take you five years at the maximum to be able to finish a degree. Once youre finished with the course, you receive a masters degree (Masters in Acupuncture or Master’s in Acupuncture and Oriental Medicine). After the finishing the program, you may now take the licensure exam. If you are planning to take licensure exam, it is advisable to enroll in an ACAOM-accredited acupuncture school as this is a requirement. Since July 1, 1999, the National Certification Commission for Acupuncture and Oriental Medicine requires that the student who shall take the examination must be a graduate of ACAOM-accredited acupuncture school. I remember my first time out, years ago, when I created a product before doing any market analysis. It was a disaster. It was too expensive to reach the market and worse of all, the price the market was willing to pay would have reduced my profit margin to near zero. I cancelled the whole project after almost a year of working on it. The lesson learned is to always begin with the customer in mind. 4. Create the sales medium and message using those benefits. Put together a convincing message that incorporates the benefits of your product or service. Those benefits should extinguish your customers have. You dont have to oversell. There are times when customers are not aware of their wants so in those cases the marketing message should identify those wants and state that you have the solution to them. When those prospects come in contact with your sales message you could restate those wants and explain the benefits you offer. 5. Craft your marketing message and design the campaign literature. Marketing is all about informing the market about your solution to their wants. Its not about selling; its about providing information- useful information. The message should be the same whether you use an article, an e-book or other devices as a vehicle. 6. Alert your target audience. There are several approaches to alerting your market but one of the most potent is to write a set of articles then contact publishers who reach the target market. Once the sale is made the only time they contact those customers on their list is when they have another item to sell them. When a Handshake is not Enough: why you need a Partnership Agreement

By Martin Truman If you set up in business with one or more other people but do not wish to set up a limited company, a partnership arrangement will be deemed to exist at law without the need for a formal contract. However, whilst a written partnership agreement is not required to form a partnership, if you wish to avoid uncertainty and the automatic application of potentially unsuitable statutory law, a formal agreement is a wise investment. What happens if we dont sign a Partnership Agreement? In the absence of a written agreement, the provisions of the 1890 Partnership Act will apply. In essence, these state that all the partners are equal and share profits, losses, start-up and running costs as well as the workload equally. Whilst the provisions are intended to provide an equitable framework for running your business, in reality, there are significant implications. For example; - all partners will be entitled to share the profits equally regardless of how much capital, effort or skill they bring into the business - any partner can bring the partnership to an end just by giving notice to all the other partners and the partnership will automatically dissolve if a partner dies - all partners will be jointly and severally liable for the liabilities incurred by the company. This means that if one partner takes on a commitment and fails to deliver on it, you will be equally liable to remedy the situation. And if a debt cannot be paid, then the creditor may pursue each of you individually, meaning that one of you may be forced into the position of paying the whole debt by yourself - should a partner get into financial difficulties then his or her creditors can take assets from the partnership to settle them - all partners will be considered “agents” of the business and so can act on behalf of the other partners. This means an individual may enter into contractual and financial arrangements which are not good for the business, but these will be binding - all partners have an equal say in the business, which means that it can take time to reach decisions. Unresolved disputes may result in the break down of the business. What benefits will a Partnership Agreement offer? A partnership agreement will provide a written structure for your business clearly setting out each partner’s responsibilities, rights, profit/liability sharing, rules relating to business entry and exit, and also the terms on which disputes are resolved and the partnership can be terminated. Carefully drafted, it will ensure that you have a common vision for the business with mutually agreed goals. Critically, it will help avoid costly misunderstandings and conflict. Key areas to cover in your partnership agreement include: a) ownership interests, taking into account any cash, assets, loans or investments made by individual partners b} salaries and compensation: how will profits or losses be allocated? c} how the partnership will be managed d) each partners specific responsibilities within the business, and what level of performance is expected from them e) whether partners expected to make a full-time commitment to the venture, or are permitted involvement in other business activities f) what processes should be followed if one partner wants to leave the partnership or a new partner is admitted g) whether partners will be allowed to sell their interests in the business to outsiders and, if so, how will their share be valued h) on what grounds a partner can be expelled from the partnership (e.g. misconduct, non-performance of duties) How do I put a Partnership Agreement in place? While there are many internet sites offering seemingly cheap pro forma partnership agreements, this can be a false economy for several reasons: 1) there are three different kinds of partnership: general partnerships, limited liability partnerships and limited partnerships you need to be sure that you set up the appropriate vehicle for your needs; 2) no two partnerships will be alike in terms of specific requirements; 3. you are unlikely to reach amicable consensus on an agreement without involving an impartial third party advisor; 4) without using a solicitor, you cant be sure that the agreement complies with partnership laws. A better way to save money is to do some preparation before instructing your solicitor: get together with your partners and compile a list of provisions that you wish to include in your partnership agreement. Your solicitor will then have a good starting point from which to clarify your requirements and draft a suitable agreement. However, since one lawyer cannot represent the interests of all partners, each partner will need to instruct their own solicitor to review the final document on their behalf. While it is true that a decrease in estate tax benefits the wealthiest two percent of Americans, it is also true that only the wealthiest two percent of Americans are subject to estate tax to begin withat least under present law. Estate taxes are taxes assessed on property transferred at the time of death. They are based on the gross estate, including real estate, insurance, trusts, annuities, cash, business interests, securities, and all other assets. The items are not assessed at their value at the time they were purchased, but rather at their fair market value at the time of death. For example, if you purchased a home for $50,000 in 1970 and the value of the property has appreciated in the meantime to be worth $175,000 based on sales of comparable properties in the same neighborhood, estate taxes would be assessed on the present worth of $175,000. Once the gross estate is calculated, applicable deductions are subtracted from that value. Deductions include property that passes to surviving spouses, mortgages and other debts, and estate administration expenses. In some cases the value of operating business interests or farms may be reduced, according to the IRS, for estates that qualify. The value arrived at after deductions is referred to as the taxable estate. Lifetime gifts are added back in and an available unified credit is applied before the estate tax is actually assessed. The good news for most of us is that your taxable estate, as an individual, must exceed $1,000,000 for estate tax to apply, as the law currently stands. The federal Tax Act of 2001 changed several provisions of the law regarding estate taxes. The rate at which estate taxes were assessed in 2001 was 55% of the gross estate less all applicable exemptions. The 2001 Tax Act began stepping estate taxes down gradually in 2002 to the present rate of 46% in 2006 and on down to 0% in 2010. The premise behind the 2001 Tax Act is that some of the revenue lost to the U.S. Government through reduction and eventual abolishment of the estate tax will be recouped by capital gains taxes that your heirs will have to pay if and when they dispose of the property bequeathed to them. Prior to 2001, heirs automatically received a full basis step-up to fair market value on inherited property and did not have to pay capital gains tax when they sold the property. At present, heirs do not enjoy that benefit. If, for example, you paid $60,000 for five acres of land in 1965 and you leave it to your son or daughter when you die. The son or daughter sells the land for $200,000 in 2006 and has to pay capital gains tax on $140,000, or the difference between what you paid for it at the time of purchase and the fair market value at the time it was sold. Needless to say, estate tax issues are extremely complicated and, if you fall into the category of wealth that would require payment of estate taxes on your demise, be sure to discuss them with your attorney or other estate planner.
